Part One sets out the terms for using the Website. Part Two explains how we handle personal information. Part Three contains general provisions that apply to both.
By accessing or using the Website, you agree to the Terms of Use in Part One. Part Two, our Privacy Policy, explains how we handle personal information and the consent that applies. Using the Website is not treated as blanket consent to all handling of your personal information. We obtain consent appropriate to the sensitivity of the information and the purpose, as described in Part Two. If you do not agree to the Terms of Use, please do not use the Website.
In this Agreement, “Kelowna Denture Clinic,” “we,” “us” and “our” refer to Kelowna Denture Clinic Inc. “You” refers to the person accessing or using the Website.
This Agreement is published on the Website. We will also provide a copy on request.
Part One: Website Terms of Use
1. The Website Is for General Information
The Website provides general information about Kelowna Denture Clinic and about dentures and related care. It is offered for your convenience and general education.
2. Not Dental or Medical Advice; No Provider-Patient Relationship
The content on the Website, including blog posts, service descriptions and answers to common questions, is provided for general informational purposes only. It is not dental, medical or health advice and it is not a substitute for a consultation with a qualified denturist, dentist or other health professional. Reading the Website or contacting us through it does not create a provider-patient or clinician-patient relationship. Always seek the advice of a qualified professional with any questions about your oral health. Never disregard professional advice or delay seeking it because of something you read on the Website. If you have a dental or medical emergency, contact your health provider or local emergency services.
3. Contacting Us Through the Website
If you submit information through our contact or consultation request form, you are responsible for the accuracy of what you provide. Please do not submit another person’s personal information without their permission. Please also avoid including detailed medical or dental history in the form. Our contact form and email are not monitored continuously, so please do not use them for urgent or time-sensitive matters. For anything concerning your care, we will arrange a phone call or an appointment. If you have an emergency, contact your health provider or local emergency services. Submitting the form does not by itself create an appointment or a professional relationship.
4. Intellectual Property
The content on the Website, including text, images, graphics, logos and the before-and-after gallery, is owned by or licensed to Kelowna Denture Clinic and is protected by applicable laws. You may view and print pages for your own personal, non-commercial use. You may not copy, reproduce, republish, modify or distribute any part of the Website without our prior written permission.
5. Acceptable Use
You agree to use the Website lawfully and not to interfere with its operation or security, attempt to gain unauthorized access, or use it in any way that could harm Kelowna Denture Clinic or others.
6. Availability and “As Is”
We aim to keep the Website available and accurate, but we provide it on an “as is” and “as available” basis. We do not guarantee that the Website will be uninterrupted, error-free or current. We may change, suspend or discontinue any part of it at any time.
7. Disclaimer and Limitation of Liability
To the fullest extent permitted by law, Kelowna Denture Clinic disclaims all warranties, express or implied, regarding the Website and its content, including warranties of accuracy, merchantability and fitness for a particular purpose. To the fullest extent permitted by law, Kelowna Denture Clinic will not be liable for any damages arising from your use of, or inability to use, the Website. Nothing in these Terms excludes or limits any liability or any rights that cannot be excluded or limited under applicable law, including your rights under PIPA.
Part Two: Privacy Policy
Kelowna Denture Clinic respects your privacy and is committed to protecting the personal information we collect through the Website. This Part explains how we collect, use, disclose and safeguard personal information. It is intended to align with British Columbia’s Personal Information Protection Act (PIPA) and other applicable Canadian privacy laws.
8. Consent
We collect, use and disclose personal information with your consent, except where PIPA permits or requires us to act without it. The form of consent depends on the sensitivity of the information. For a routine website inquiry, providing your information through the form is your consent for us to use it to respond to you. For a new purpose, or for sensitive information, we will seek the appropriate form of consent at the time. You may withdraw your consent at any time, subject to legal or contractual limits and reasonable notice, by contacting our Privacy Officer. Withdrawing consent may affect our ability to provide certain services.
9. Scope of the Privacy Policy
This Privacy Policy applies to personal information collected through the Website, including information you provide through our contact or consultation request form and information collected automatically as you browse. It covers personal information about website visitors, prospective patients, patients and anyone who contacts us on another person’s behalf. It does not apply to the clinical records and personal health information we collect and manage in the course of providing denture care at our clinic, which are handled under PIPA and our professional obligations as a registered denture practice. The Website is not designed or intended to collect health information. If you choose to include health details in a message to us, we will handle that information with the safeguards described in this Privacy Policy and under PIPA, using it only to respond to you. We still ask that you avoid sending sensitive health details through the Website. For information about how we handle your clinical records, or to access or correct them, please contact the clinic directly and ask for our clinical privacy information.
10. Information We Collect
Information you provide. When you complete our contact or consultation request form, or contact us by email or phone, we may collect your name, email address, telephone number, the message or details you choose to provide and the page of the Website from which you submitted the form.
Information collected automatically. When you visit the Website, we may automatically collect technical and usage information such as your IP address, device and browser type, operating system, referring website, pages viewed and the dates and times of your visit. We collect this using cookies and similar technologies, including website analytics tools such as Google Analytics and, from time to time, session-analytics tools such as Hotjar or Contentsquare. Session-analytics tools record how visitors interact with pages, which can include clicks, scrolling, mouse movement and a replay of the session. These tools are set up so that what they record is anonymous. They do not capture anything you type into a form or any information that identifies you.
11. How We Use Personal Information
We use the personal information we collect to respond to your inquiries, arrange and provide consultations and denture services, communicate with you, operate and improve the Website, understand how the Website is used, maintain security and comply with our legal and professional obligations. Within KDC, access to personal information is limited to the authorized staff and providers who need it for these purposes.
12. Cookies, Analytics and Session Tools
We use cookies and similar technologies to operate the Website, remember preferences, analyze usage and improve your experience. The analytics and session tools described above help us understand how the Website is used.
Your choices. Most browsers let you manage or block cookies through their settings. Blocking cookies will stop the analytics and session tools from running on your device, though it may affect how the Website functions. You can also opt out of Google Analytics using the Google Analytics opt-out browser add-on.
Advertising. We do not use advertising or remarketing pixels, nor cookies for advertising or remarketing. Apart from the cookies needed to run the Website and the analytics and session tools described above, we do not use other cookies.
13. How We Share Personal Information
We do not sell your personal information. We may share personal information with service providers who perform services on our behalf, such as our website host and developer, analytics providers and session-analytics providers. These providers are authorized to use personal information only as necessary to provide services to us. We may also disclose personal information where required or permitted by law, or where necessary to protect the rights, safety or property of Kelowna Denture Clinic, our patients or others.
14. Storage and Cross-Border Processing
Some of our service providers, including analytics providers, may store or process information on servers located outside of Canada, including in the United States. Where that is the case, your information may be subject to the laws of those jurisdictions. If you have questions about the collection, use or storage of your personal information by service providers outside Canada, please contact our Privacy Officer using the details in Part Three.
15. Retention
We keep personal information only for as long as reasonably necessary to fulfil the purposes described in this Privacy Policy, to meet our professional and legal obligations and to resolve disputes. If we use your personal information to make a decision that directly affects you, PIPA requires us to keep that information for at least one year afterward, so that you have the opportunity to request access to it. That one-year period is a minimum for that situation. Where other legal or professional requirements apply, including the rules that govern clinical records, those longer periods govern.
Periods we set. Website inquiries are kept while they are relevant to your request and for a reasonable period afterward in case of follow-up, then securely deleted. Analytics and session-recording data are kept according to the standard retention periods and settings of the tools we use.
16. Destruction
When personal information is no longer needed, we destroy, erase or anonymize it using methods appropriate to its format: secure deletion of electronic records, shredding of any paper copies, or removal of identifying details. Information held within our service providers’ systems is deleted according to their processes and backup cycles, so deletion may not be immediate in every system.
17. Safeguards
We maintain reasonable administrative, technical and physical safeguards to protect personal information against loss, theft and unauthorized access, use or disclosure.
No method of transmission or storage is completely secure. We cannot guarantee absolute security.
18. Your Privacy Rights
Under PIPA, you have the right to access the personal information we hold about you and to request corrections. You may also withdraw consent to certain uses, subject to legal and contractual limitations, as described in the Consent section. To make a request, contact our Privacy Officer in Part Three. We may need to verify your identity before responding.
19. Complaints
If you have a concern about how we have handled your personal information, please contact our Privacy Officer using the details in Part Three. We will acknowledge your complaint and respond within a reasonable time. If you are not satisfied with our response, you may contact the Office of the Information and Privacy Commissioner for British Columbia, which oversees PIPA, at oipc.bc.ca.
20. Children’s Privacy
The Website is intended for a general adult audience and is not directed to children. We do not knowingly collect personal information from children through the Website.
Part Three: General Provisions (apply to the Terms of Use and the Privacy Policy)
21. Third-Party Links
The Website may contain links to third-party websites for your convenience. We do not control and are not responsible for the content, availability, privacy practices or policies of those websites. We encourage you to review their terms and privacy policies.
22. Changes to This Agreement
We may update this Agreement from time to time by posting a revised version on the Website with a new effective date. For changes to the Terms of Use, your continued use of the Website after a revised version is posted constitutes acceptance. For changes to our privacy practices, we will obtain your consent where the law requires it. A significant new purpose or disclosure may require fresh consent rather than relying on your continued use.
23. Governing Law
This Agreement, including the Terms of Use and the Privacy Policy, is governed by the laws of the Province of British Columbia and the applicable laws of Canada.
